What Actually Killed CLARITY
The cloture vote on H.R. 3633 failed 49 to 50 Tuesday afternoon, 11 votes short of the 60 needed to open debate. All 49 yeas were Republican. No Democrat voted yes. Chris Coons did not vote. King and Sanders voted no.
Gallego and Alsobrooks voted the bill out of committee in May. Both voted no on the floor.
Polymarket had this becoming law in 2026 at 82% in February. Monday night it was 18%. After the vote it was a 6-handle.
Three Republicans joined the no votes: Susan Collins, Josh Hawley, and Jerry Moran. Thom Tillis also voted no, but procedurally he switched his own vote to sit on the winning side. That keeps him eligible to file a motion to reconsider later. The mechanic only works if you voted with the side that won.
The break came that morning. The floor vote was just the formality. Republicans released their final substitute text Sunday night, incorporating 126 Democratic-requested changes. Democrats sent a counteroffer Monday night. Republicans rejected it Tuesday morning, ending negotiations a few hours before the vote.
What's Actually Left of 2026
Cynthia Lummis warned ahead of the vote that momentum like this would not come around again this decade. Ted Cruz was less final, saying there's "a big difference between dead and mostly dead."
The calendar does most of the killing. The House is out of working weeks before the midterms. Midterms are seven weeks out. Tillis's motion to reconsider buys a procedural option, not floor time nobody has.
None of this pauses the agencies. SEC Chair Atkins said September 14 the SEC proceeds "with or without" the bill. The CFTC is on the same track.
The Event Markets Haven't Priced Yet
Markets are pricing a high probability of a 25 basis point hike, 3.50–3.75% to 3.75–4.00%. First hike since 2023. First change of the Warsh chairmanship.
Warsh set this up at Jackson Hole in August. "Otherwise, we have work to do." After that line, September hike odds jumped from the mid-30s to the high-50s within a day.
July's meeting already showed the fracture. The Committee held rates on a 9-3 vote. Beth Hammack, Neel Kashkari, and Lorie Logan dissented. All three wanted a hike then. Today is the follow-through test of that minority.
Retail sales for August print at 8:30 a.m. ET, the last data point before the statement. The calendar runs: 8:30 retail sales, 2:00 p.m. statement plus SEP, 2:30 p.m. press conference.
Watch the dot plot and the statement language more than the 25 basis points. The size of the move is already priced. The path after today is not.
Why Bitcoin Is Feeling Both at Once
The 10-year Treasury yield crossed 5% this week for the first time since late 2023. That is doing work independent of the funds rate. Higher long-end yields raise the discount rate for risk assets. They compete with a zero-yield asset for capital.
Spot ETF flows flushed last week. Four sessions of outflows totaled about $463 million. Monday saw $160 million come back, almost all into IBIT and FBTC. That is concentrated re-entry after a flush, not hesitation in both directions.

The two stories compound rather than cancel. A stalled regulatory framework removes one source of institutional comfort. A hike raises the cost of capital for the assets that comfort was supposed to attract. Both landed in the same week.
